Small Business Restructuring

A process to settle debts that allows company directors to remain in control of their business.  Eligibility requirements must be met including: debts less than $1m, tax lodgements made and employee entitlements paid.

Voluntary Administration & Deed of Company Arrangement (DOCA)

An administrator takes control of the business, undertakes investigations and reports to creditors whether to place the company into liquidation or accept a DOCA to settle debts and return control to the director.

Creditors Voluntary Liquidation (CVL)

Shareholders vote to liquidate an insolvent company . A liquidator investigates the company’s affairs, to equitably distribute any surplus assets to creditors.

Court Liquidation

An application is made to the Court, usually by a creditor due to unpaid debts, to wind up a company.   

Receiverships

A secured creditor usually appoints a Receiver and Manager over assets and a business to recover lent money – the Receiver realises assets to distributes accordingly.  This may follow an Independent Business Review report prepared for the secured creditor.    

Independent Business Reviews

A report prepared for business owners providing strategic analysis of the financial position and performance of a business, to identify issues and assist with turnaround and profit improvement.
